Introductory provisions

These general terms and conditions govern the mutual rights and obligations between Fortal Partners s.r.o., registered office at Zenklova 24/54, Libeň, 180 00 Praha 8, IČO: 248 94 036, DIČ: CZ24894036 (hereinafter „Fortal“) and the client in the provision of coaching, educational, and advisory services, including the delivery of digital products, gift vouchers, and access to the Fortal zóna client portal.

Conclusion of the contract

A contract for the provision of services arises on the basis of the client's order and its subsequent confirmation by Fortal, usually by email.

An order can also be placed through the order forms on the fortal.cz website (corporate order, gift voucher, event registration). In such a case, the contract arises the moment Fortal confirms the order by email with a summary of the ordered performance. The client is responsible for the accuracy of the details provided in the order.

Price and payment terms

The price of the services is agreed individually and stated in the offer or with the relevant service on the website. We are not VAT payers.

Payment is made on the basis of an issued invoice with a due date of 14 days, unless otherwise agreed. Fortal reserves the right to require payment of the price before the service is provided. For services ordered via the website (e.g. sending out access codes for a corporate order or redeeming a voucher), the start of performance may be conditional on payment of the invoice.

Cancellation and change of date

The client may cancel or change an agreed service date under the following conditions:

• more than 48 hours in advance: no fee
• less than 48 hours in advance: 100 % of the service price

Fortal may, at its discretion, allow a one-time change of date without a cancellation fee.

For public and corporate events (workshops, conferences, lectures, webinars, and other events) the following applies instead:

• cancelling a registration more than 3 days before the event: refund of 100 % of the price paid
• cancelling less than 3 days before the event or non-attendance: no entitlement to a refund

A free registration can be cancelled at any time. If Fortal cancels the event, it refunds participants 100 % of the price paid.

Gift vouchers

A gift voucher entitles its holder to use the service stated on it. The voucher is issued and delivered by email after the order; it can be redeemed after the invoice for its purchase has been paid.

• the voucher is valid for 6 months from issue; the validity date is stated directly on the voucher
• the voucher is single-use and cannot be exchanged for money or refunded for a difference in price
• after the validity period expires, the entitlement to use the service lapses without compensation
• the date for using the service from the voucher is subject to the cancellation terms under article 4

CliftonStrengths assessment and access codes

Some services include an access code for the online CliftonStrengths assessment by Gallup. The code is single-use and is intended solely for the person it was sent to.

The assessment itself takes place on Gallup's pages under its terms of use; the assessment results are stored in the account that the participant creates with Gallup. Fortal has no influence over the terms or availability of Gallup's services. By using the code, the code is considered redeemed.

Provision of services

Fortal undertakes to provide services with professional care.

The services are developmental and advisory in nature. Fortal does not provide medical or psychotherapeutic services and does not guarantee specific results.

The client acknowledges that all decisions are made at their own responsibility.

Digital products

In the case of the delivery of digital content (e.g. assessments, reports), the client acknowledges that:

• delivery may take place immediately after payment
• by this the client grants consent to the start of performance before the withdrawal period expires
• and thereby loses the right to withdraw from the contract

The delivered reports and development materials are intended for the client's personal use, or for the internal use of their company; their further distribution or sale is not permitted.

Fortal zóna (client portal)

If access to the Fortal zóna client portal is part of the cooperation, it lasts for the agreed period; after it expires, the portal is locked for the company. Access is intended only for the client's invited users; the client is responsible for ensuring that its users do not pass access links on to third parties.

The processing of personal data of the client's employees in the portal is governed by the data processing addendum to the contract and by the Personal data protection page (fortal.cz/gdpr). Fortal may briefly interrupt the operation of the portal for maintenance reasons.

Withdrawal from the contract (consumer)

A consumer has the right to withdraw from the contract within 14 days of its conclusion.

However, if the provision of the service begins at the client's express request before this period expires, Fortal has the right to a proportionate part of the price for the performance already provided.

In the case of full provision of the service, the right to withdraw lapses.

For events held on a set date (use of leisure time within the meaning of Section 1837(j) of the Civil Code), the right to withdraw from the contract does not arise; the cancellation terms under article 4 apply.

Confidentiality and personal data protection

Fortal maintains confidentiality regarding all information obtained in the provision of services, except in cases stipulated by law.

Information about the processing of personal data, including the list of processors and your rights, is provided on the Personal data protection page (fortal.cz/gdpr). For corporate clients whose employees are affected by the processing, a data processing addendum is part of the contract.

Liability

Fortal is not liable for the client's decisions made on the basis of the services provided.

Fortal's liability for any damage is limited to the amount of the price of the service provided.

Final provisions

These terms and conditions take effect on the day of their publication.

The legal relationships are governed by the law of the Czech Republic.
